May 2025 में Mumbai के एक Zomato delivery partner ने अपने Instagram पर एक food delivery photo post की — background में clearly customer के घर का door number और एक car का number plate visible था।

Personal Data

Element Personal Data? Risk Level Notes
Human face (recognisable) Yes (biometric category) High DPDP/GDPR दोनों में special category
Vehicle number plate Yes Medium RTO records से owner identifiable
Door number / address Yes Medium Specific residence locate होता है
Uniform/ID badge Possibly Medium Identifiable employer/role
Handwritten text/signature Yes High Signatures = personal identifier
Screen content (accounts, emails) Yes High Screenshots में Aadhaar, PAN, mobile numbers
Aadhaar card visible Yes Critical UIDAI regulation + DPDP both
PAN card visible Yes Critical Income Tax Act + DPDP both
Voter ID visible Yes Critical Election Commission regulation

EXIF में छिपा Personal Data

  • GPS coordinates: precise location within a few meters
  • Timestamp: second-level accurate capture time
  • Device info: phone model, OS version
  • Software: editing app name and version
  • Camera serial number: traceable to specific device owner

भारत में DPDP Act full enforcement phase में है (rules notified Sept 2025, enforcement from Q1 2026 onwards)। Image sharing पर कुछ key provisions:

Section 4 — Grounds for Processing

Personal data (including images containing personal data) process

  1. Consent: Data principal (जिसकी photo है) का explicit consent
  2. Legitimate use: Employment, state function, medical emergency, etc.
  3. Public interest: Journalism exemption (Section 17), research, statistical purposes

Section 11 — Right to Erasure

Section 33 — Penalties

  • Significant harm: ₹50 crore तक
  • Breach of obligation: ₹250 crore तक (worst case)
  • Child-related violations: higher penalties

Children's Data (Section 9)

GDPR — Cross-border Indian Businesses

Article 6 — Lawful Basis

Photos with personal data process करने के लिए लगभग same grounds:

  1. Consent: Explicit, informed, revocable
  2. Legitimate interest: Business purpose, balanced against rights
  3. Public interest: Journalism, public safety

Strongly recommended: Commercial photo use (marketing, event documentation) के लिए written consent।

Article 9 — Special Categories

Articles 15-22 — Data Subject Rights

Subject demand

  • Right to access: उसकी सभी photos की list
  • Right to erasure (Right to be forgotten): photos deletion
  • Right to object: ongoing use stop

DPDP vs GDPR — Quick Compare

Aspect DPDP Act 2023 (India) GDPR (EU)
Applicability Data of persons in India Data of persons in EU
Cross-border transfer Restricted list approach Adequacy decisions + SCCs
Max penalty ₹250 crore 4% global turnover or €20M
Consent age 18 16 (member states can lower)
Right to erasure Yes Yes
Breach notification To DPB + affected To DPA within 72 hrs
Journalism exemption Yes (Section 17) Yes (Article 85)

Image Anonymization Techniques

1. Blur (Gaussian blur)

Face, plate, door number पर Gaussian blur apply। Recommended: Gaussian blur radius ≥20 px, या pixelation ≤8×8।

2. EXIF Removal

Before sharing:

  • ExifTool (cross-platform CLI): exiftool -all= photo.jpg
  • mat2 (Linux): batch metadata removal multiple formats
  • Windows: Right-click → Properties → Details → "Remove Properties and Personal Information"
  • Android apps: Photo Exif Editor, Scrambled Exif
  • iOS: ViewExif, or iOS 15+ built-in "Remove Location" during share

3. Crop

4. Automated Anonymization

Google Cloud Vision API, AWS Rekognition से automatic face/plate detection + blur। Bulk processing के लिए (event photographers, real estate)।

Indian Scenarios — Common Privacy Mistakes

Mistake 2: Real estate agent property tour video post करता है Current tenant की belongings + identity visible। Tenants का consent ज़रूरी, या staged photos only।

Mistake 3: Hindi YouTuber neighbourhood vlog में random passersby Commercial intent (monetized channel) + recognisable faces = potential violation।

Mistake 6: Doctor/clinic patient before-after photos Medical context में sensitive personal data + sometimes special category। Written consent + specific use description + retention period मandatory।

Responsibility

  • Applicable data protection laws follow करना

Image Host की Responsibility

Image host "Data Processor" है (Data Controller नहीं)। Main responsibilities:

  • Secure storage environment provide करना
  • Legitimate takedown requests पर compliance
  • User content का unauthorized use नहीं
  • Log retention as per legal requirement

Free image host scenarios में Terms of Service के through यह implicit है।

Business Compliance Checklist

Indian business जो customer/employee photos share करती है:

  • Photo से पहले consent form signed?
  • Consent में use scope clearly mentioned?
  • Non-necessary faces/plates blurred?
  • Takedown request handling process defined?
  • Image hosting platform DPDP-compliant?
  • Consent records और processing log retained?
  • Cross-border transfer (US-based image host) assessed against DPDP transfer rules?
  • Data breach notification plan defined?

  1. Identity verify: actual data principal है ये confirm (ID proof request)
  2. Legitimacy assess: Legal basis है? (DPDP Section 11 right to erasure, GDPR Article 17)
  3. Timely response: DPDP में reasonable period (typically ≤30 days), GDPR 30 days
  4. Execute deletion: सभी platforms से — image host, social media, cached versions
  6. Document: Takedown request और action log retain (compliance evidence)

Image Host selection — Privacy Considerations

Cross-border transfer?
  • EXIF handling: auto-strip है, partial strip है, या preserve?
  • Deletion mechanism: user can self-delete? timely?
  • Encrypted transfer: HTTPS only?
  • Access control: password protection, expiry options?
  • Terms of Service: user content का platform-side use allow करता है?

lpic.cc privacy-conscious users के लिए practical features देता है: auto EXIF removal (GPS समेत), password protection for access restriction, HTTPS transfer।

FAQ

Q1: Public place में photo लेते हुए background people के consent चाहिए?

Depends on purpose. Casual street photo जिसमें lot of anonymous people हैं — generally fine for personal social media।

First enforcement actions Q2 2026 में expected हैं — initial targets likely large platforms और big data collectors।

(Masked Aadhaar from UIDAI); (2) Photo clearly "For [purpose] only" watermark

Conclusion

अच्छी बात — कुछ simple habits अपना लो: consent take करो, EXIF remove करो, sensitive parts blur करो।
